ProSurvey Apps Limited (registered in England and Wales with company number 17118570) ("we", "our", or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit our website or use our mobile applications (including "DampApp Pro" and "PropertySurvey Pro") and our practices for collecting, using, maintaining, protecting, and disclosing that information.
HousingSurvey Pro™ — separate privacy policy applies
HousingSurvey Pro is our web-based B2B platform for the housing sector, with its own distinct data-controller/processor model (it processes tenant/property data on a housing organisation's behalf, under that organisation's instructions). It has its own dedicated Privacy Policy, Data Processing Agreement and Cookie Notice at housingsurvey.pro/legal, which govern it specifically. This policy's mobile-app sections (cloud retention limits, subscription data, in-app third-party services) describe DampApp Pro and PropertySurvey Pro only.
1. Information We Collect
We collect several types of information from and about users of our applications, including:
- Personal Information: Name, email address, phone number, company details, and other contact information you provide when you register for an account, generate reports, or contact us.
- Subscription and Account Status: App-user and customer identifiers, app/platform details, subscription or trial status, entitlements, and purchase, renewal, cancellation, or expiry history, together with associated contact details. We may receive this information from RevenueCat, which manages subscription information for us, and combine it with information held in our own systems.
- Survey Data: Information, photos, and notes you input into our apps while conducting surveys. This data is stored locally on your device and synchronized to our cloud servers if you subscribe to our PRO features.
- Usage Details: When you access and use the apps, we may automatically collect certain details of your access to and use of the apps, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the applications.
Microphone & Voice Dictation
Our apps include an optional voice dictation feature so you can speak survey observations instead of typing them. If you choose to use it, the app requests access to your device's microphone. Your speech is converted to text by your device's built-in speech recognition service (provided by Apple on iOS and Google on Android); to perform this conversion, your operating system may transmit the audio to Apple or Google for processing, subject to their respective privacy policies. We do not record, store, listen to, or transmit your audio to our own servers — only the resulting transcribed text is saved, as part of the survey content that you control. The feature is entirely optional: if you do not grant microphone permission, or simply do not use dictation, no audio is captured or processed.
2. How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:
- To provide you with the applications and their contents, and any other information, products, or services that you request from us.
- To fulfill any other purpose for which you provide it (e.g., generating survey reports).
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- To notify you about changes to our apps or any products or services we offer or provide though them.
- To provide onboarding or subscription help, ask for feedback, and, where the law permits, tell you about subscriptions and similar ProSurvey products or services that may be relevant to you.
- To maintain a suppression record so that we continue to respect marketing opt-outs.
Product Follow-up & Direct Marketing
We may use limited account, contact, app-usage, and subscription-status information — including information received through RevenueCat — to identify people who have installed or used one of our apps but have not started a paid subscription, or whose trial or subscription has ended. We may contact them to offer help, ask for feedback, or explain our own similar products and subscription options. We rely on our legitimate interests in supporting users and developing and promoting our services only where a balancing assessment shows that those interests are not overridden by the individual's rights. Where consent is legally required, we rely on consent instead.
Simply installing an app or creating an account does not by itself amount to consent to electronic marketing. We send email, text, telephone, or similar direct marketing only where permitted by applicable law — for example, with consent, under the limited PECR "soft opt-in" where every requirement is met, or under the rules applicable to corporate subscribers and business contacts. Every marketing communication will identify us and provide a simple way to opt out. You may object to direct marketing at any time; we will stop using your information for that purpose and retain only the minimum suppression information needed to respect your choice.
3. Surveyor Responsibilities as Data Controller
When using ProSurvey Apps to collect and process data relating to your clients, you act as the Data Controller under the General Data Protection Regulation (GDPR) and equivalent frameworks. You are solely responsible for ensuring you have the legal right and necessary permissions to collect, store, and process your clients' personal information through our applications.
It is entirely your responsibility to manage data subject requests (such as requests for deletion, access, or export of client data) and to verify the accuracy of all data inputted into or generated by the applications. We act strictly as a data processor in this context and accept no liability for regulatory data breaches originating from your use of the apps.
4. Data Retention & Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.
While we strive to protect your data, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security and accept no liability for accidental data loss arising from server outages, device failure, or internet disruptions. Users are responsible for regularly exporting and securing their own client data.
Cloud Data Retention Policy
To maintain server performance and minimize privacy risks, we automatically purge stale data from our cloud databases. By using ProSurvey Apps, you acknowledge and agree to the following automated deletion schedules:
- Expired PRO Subscriptions: If your PRO subscription expires or is cancelled, you have a 30-day grace period to export your data or renew. After 30 days, all your cloud-synced surveys, images, and profile data will be permanently deleted.
- Inactive Accounts: Any account (Free or PRO) that has not been logged into or actively opened for 365 consecutive days will be permanently deleted, including all associated cloud storage.
- Storage Caps: To maintain system performance, Free accounts are strictly limited to retaining 25 surveys at any time. Active PRO accounts are permitted to store up to 5,000 cloud-synced surveys. Users nearing these limits must manually permanently delete or externally export obsolete surveys to free up storage space.
- Data Portability & Export Modalities: To assist you with your GDPR obligations, our apps provide several data export options including PDF exports and JSON mass import/exports. Note that raw JSON exports explicitly exclude local media to minimize unencrypted payloads during transfer.
Marketing Records
A contractor's working copy of a contact list is limited to the relevant campaign or contract and must be securely deleted or returned when no longer required. We periodically review our own follow-up records and keep them only while they remain relevant and lawful. If you opt out or object, we may retain a minimal suppression record for as long as needed to ensure that we do not contact you again for direct marketing.
5. Third-Party Services
Our applications may integrate with third-party application programming interfaces (APIs) and services such as RevenueCat (for subscription and identity management), Google Gemini, OpenWeatherMap, Open-Meteo, RainViewer, the GOV.UK Energy Performance of Buildings Data Registry, or user-defined SMTP servers. Certain data (such as generalized property locations, postcodes, anonymized image data, or basic contact information tied to subscriptions) may be processed by these services for the relevant purpose. Where a provider acts as our processor, we require appropriate contractual and security safeguards; a service that you independently choose or configure may process information under its own terms and privacy policy.
We may give a contracted marketing, communications, or user-support specialist limited access to a contact list so that they can carry out the follow-up described in section 2 only on our behalf and documented instructions. The limited fields may include name, business or personal contact details, app/account identifiers, app used, and subscription or trial status and dates. We do not give them survey content, property information, photographs, notes, or your clients' data for this purpose. They must keep the information confidential and secure, may not sell it or use it for their own purposes, and must delete or return it at the end of the work. We remain responsible for this processing. We do not sell your personal data.
6. Cookies, Analytics & Advertising
Our websites use strictly necessary cookies to function. With your consent, we also load marketing and analytics cookies from third-party advertising and analytics partners — currently the Meta Pixel (Meta Platforms, Inc.) and the LinkedIn Insight Tag (LinkedIn Corporation), and we may add or change comparable partners in future. These help us understand how visitors find ProSurvey Apps and measure the performance of our advertising. No marketing or analytics cookies are set until you accept them via our cookie banner, and you can withdraw consent at any time by clearing the cookies in your browser. We use this data for our own analytics and advertising measurement only — we never sell your personal data. These partners process data in accordance with their own privacy policies, and where required we rely on privacy-preserving and consent-based mechanisms rather than cross-app device tracking.
7. Your Rights & Marketing Choices
Under UK data protection law, you may have rights to request access, rectification, erasure, restriction, or portability of your personal data, and to object to certain processing. You may also withdraw consent at any time where we rely on consent. These rights may be subject to legal limits.
Your right to object to the use of your personal data for direct marketing is absolute. Use the unsubscribe or opt-out method in the communication, tell the person contacting you, or use our marketing opt-out form. You can also email [email protected]. We will honour the request and place the minimum details on our suppression list. You may also complain to the UK Information Commissioner's Office.
