Terms of Service

Please read these terms carefully before using our applications.

These Terms of Service ("Terms") constitute a legal agreement between you ("User") and ProSurvey Apps ("we", "us", or "our") governing your use of our mobile applications—including DampSurvey Pro and PropertySurvey Pro—and related services.

End User License Agreement (EULA)

Our applications are licensed, not sold, to you. By downloading or using our apps, you explicitly agree to Apple's Standard End User License Agreement (EULA), which serves as the primary governing contract for your use of this software on iOS devices.

1. Subscription & Payments

ProSurvey Apps offer auto-renewable subscriptions (PRO features) to access premium tools inside the applications.

  • Billing & Renewal Payment will be charged to your iTunes or Google Play Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Management Account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in your Account Settings after purchase.
  • Google Play Users If you subscribe via Google Play, your use is subject to the Google Play Terms of Service. Changes to your payment method or cancellation must be handled through the Play Store.

2. Acceptable Use Policy

You agree not to use ProSurvey Apps to store or transmit any content that is illegal, offensive, discriminatory, or infringes on the intellectual property or privacy rights of others. We reserve the right to suspend or terminate accounts and delete any data that violates these terms or poses a security risk to our infrastructure, without prior notice.

3. Intellectual Property

The applications, including source code, design, graphics, and trademarks, are the exclusive property of ProSurvey Apps. You are granted a limited, non-exclusive, non-transferable license to interpret and use the apps for their intended purpose. You may not reverse engineer, copy, or attempt to extract the source code of the applications.

4. Disclaimer of Liability

No Warranty & Data Loss

The applications are provided on an "as is" and "as available" basis without any warranties of any kind. We do not guarantee that the apps will be uninterrupted, continuous, or error-free. We accept no liability for any loss of data, loss of business, or loss of profits resulting from software bugs, server downtime, syncing failures, or device malfunction. Users are strongly advised to regularly export and back up their survey data.

Professional Use Only

Our applications are tools designed to assist professionals. We accept no liability for any direct, indirect, or consequential loss arising from the reliance on calculations, data, or reports generated by these apps. It is your responsibility to verify all survey findings using your professional judgment and standard industry practices.

AI & Automated Content

Certain features utilize Artificial Intelligence (AI) to assist with text generation and image analysis. AI can produce inaccurate, flawed, or misleading content. You are entirely responsible for reviewing, verifying, and editing all AI-generated text before using it in any professional capacity.

Data Controller Responsibility

Surveyors act as the Data Controllers for their clients' data and are entirely responsible for fulfilling data subject requests (e.g., deletion, export) and verifying all data inputted or automatically generated by the application. We are not liable for any inaccurate readings, misdiagnoses, or regulatory data breaches originating from the surveyor's use of the apps.

Communications & Email Delivery

If you utilize the custom SMTP email configuration, you are solely responsible for compliance with any anti-spam legislation (e.g., CAN-SPAM, PECR). We do not guarantee the deliverability of emails sent through your configured SMTP servers and accept no liability for emails marked as spam or undelivered reports.

5. Cloud Data Retention & Deletion

We provide cloud synchronization services for convenience but they are not intended to be a permanent, guaranteed backup solution. To reduce storage bloat and maintain compliance with data minimization principles, we strictly enforce the following automated deletion protocols:

    30-Day Pro Expiry Rule If your Pro subscription expires, you are granted a 30-day grace period. After 30 days without an active subscription, all cloud-synced surveys, settings, and media associated with your account will be permanently and irretrievably deleted.

    365-Day Inactivity Rule Any account that has not been opened or logged into for 365 consecutive days will be considered abandoned and automatically purged from our databases, regardless of subscription status.

    Database Storage Caps To maintain system stability, active Pro accounts are strictly limited to storing a maximum of 5,000 surveys in the cloud. Free accounts may store up to 3 surveys locally. Users are obligated to manage their storage by securely exporting their data to PDF or JSON prior to deleting obsolete entries to make room for new surveys. Once deleted, data cannot be recovered.

6. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the service.

7. Governing Law & Jurisdiction

These terms shall be governed by and construed in accordance with the laws of England and Wales, or, where applicable for consumer protection, the jurisdiction of your primary residence, without regard to its conflict of law provisions. The Service is intended for international usage and users must ensure compliance with their local regulations.
